These Terms of Use ("Terms") are an agreement between you and One Media Labs ("we") governing your use of the Baby Guardian app. By installing or using the app you accept these Terms. If you do not accept them, do not use the app.
Baby Guardian is a convenience and wellness tool, not a safety device and not a medical device. It does not detect, diagnose, prevent, or treat any medical condition, and it must never be used as a substitute for direct adult supervision of a child.
The app depends on your devices, their batteries, your Wi-Fi or mobile network, and the operating system continuing to run it. Any of these can fail without warning. Never rely on the app as your only means of monitoring a child.
You must be at least 18 years old and legally able to enter into a contract to use Baby Guardian. The app is intended for parents and caregivers, not for use by children.
You are responsible for keeping your login credentials and, if you enable it, your media passphrase secure. You are responsible for activity that happens under your account. Tell us immediately at support@guardian-baby.com if you believe your account has been compromised.
If you set a media passphrase and lose it, your encrypted photos cannot be recovered by us or by anyone else.
You may only use Baby Guardian to monitor children in your own care, or where you have the clear, informed consent of everyone who may be recorded. You must not:

Baby Guardian offers a free trial followed by an auto-renewing subscription. Key terms:
Photos, clips, and event data you create remain yours. We store them only to provide the service, and they are deleted automatically after 30 days or immediately when you delete them. We do not use your content to train models, and we do not sell it. See our Privacy Policy for full detail.
We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and we may perform maintenance that temporarily interrupts the service.
To the maximum extent permitted by law, the app is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages, or for any harm arising from reliance on the app for the supervision or safety of a child. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.
Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
You may stop using the app and delete your account at any time from More → Delete account or the account deletion page. We may suspend or terminate accounts that breach these Terms.
We may update these Terms. If changes are material we will update the date above and notify you in the app where required. Continuing to use the app after changes take effect means you accept them.

Giriş bilgilerinizin ve (etkinleştirdiyseniz) medya parolanızın güvenliğinden siz sorumlusunuz. Hesabınız altında gerçekleşen işlemlerden siz sorumlusunuz. Hesabınızın ele geçirildiğini düşünüyorsanız derhal support@guardian-baby.com adresine yazın.
Bir medya parolası belirleyip kaybederseniz, şifrelenmiş fotoğraflarınız ne bizim ne de bir başkası tarafından kurtarılabilir.
Baby Guardian'ı yalnızca kendi bakımınızdaki çocukları izlemek için veya kaydedilebilecek herkesin açık ve bilgilendirilmiş rızası varsa kullanabilirsiniz. Şunları yapamazsınız:
Görüntü ve ses kaydına ilişkin ülkenizdeki mevzuata uymaktan yalnızca siz sorumlusunuz.
Baby Guardian, ücretsiz deneme ve ardından otomatik yenilenen abonelik sunar. Temel koşullar:
Oluşturduğunuz fotoğraflar, klipler ve olay verileri size aittir. Bunları yalnızca hizmeti sunmak için saklarız; 30 gün sonra otomatik olarak veya siz sildiğinizde derhal silinir. İçeriğinizi model eğitiminde kullanmaz ve satmayız. Ayrıntı için Gizlilik Politikası'na bakın.
Hizmeti erişilebilir tutmayı hedefleriz ancak kesintisiz veya hatasız çalışacağını garanti etmeyiz. Özellikleri değiştirebilir, askıya alabilir veya sonlandırabilir; hizmeti geçici olarak kesintiye uğratan bakımlar yapabiliriz.
Yasaların izin verdiği azami ölçüde uygulama "olduğu gibi" sunulur ve hiçbir garanti verilmez. Dolaylı, arızi veya sonuç niteliğindeki zararlardan ya da uygulamaya bir çocuğun gözetimi veya güvenliği için güvenilmesinden doğan zararlardan sorumlu değiliz. Bu Koşullardaki hiçbir hüküm, ihmalden kaynaklanan ölüm veya bedensel zarara ilişkin sorumluluk dâhil, kanunen sınırlandırılamayan sorumluluğu sınırlamaz.
Sorumluluğun hariç tutulamadığı hallerde toplam sorumluluğumuz, talebe konu olaydan önceki 12 ayda bize ödediğiniz tutarla sınırlıdır.
Uygulamayı kullanmayı bırakabilir ve hesabınızı dilediğiniz an Daha Fazla → Hesabı sil veya hesap silme sayfası üzerinden silebilirsiniz. Bu Koşulları ihlal eden hesapları askıya alabilir veya kapatabiliriz.
Bu Koşulları güncelleyebiliriz. Değişiklikler önemliyse yukarıdaki tarihi güncelleriz ve gereken hallerde uygulama içinde bildiririz. Değişiklikler yürürlüğe girdikten sonra kullanmaya devam etmeniz kabul ettiğiniz anlamına gelir.
